FORT LAUDERDALE - On November 14, 2016, the Plaintiff in a negligence action filed a complaint against Walgreen Co., alleging they were responsible for a slip and fall incident.
According to the complaint, on October 4, 2015, Walgreens willfully and unlawfully sold alcoholic beverages to the Plaintiff who was seventeen years old, below the legal drinking age of 21 years old. The Plaintiff consumed the alcohol and became intoxicated. While the Plaintiff was intoxicated and impaired by the alcohol purchased from Walgreens, he attempted to sit on the outer ledge of a parking structure located on the top floor of a parking garage in Fort Lauderdale. The Plaintiff fell over said structure, ultimatey falling five stories. The Plaintiff sustained permanent and catastrophic injuries.
The Plaintiff is alleging that the Defendant is responsible for the injury sustained by the Plaintiff. The acts and omissions of Walgreen Co. in selling alcohol to the Plaintiff lead to his intoxication which caused him to have impaired judgement, impaired mental facilities, and increased risk-taking behaviors. The acts also lead to the Plaintiff's impaired motor functions and balance.
The Plaintiffs demand judgment against the Defendant for damages in excess of $15,000, plus costs, and demands a trial by jury. Additionally, the Plaintiffs are represented by Joshua M. Entin, ESQ. of Entin & Della Ferra, P.A in Fort Lauderdale.
