FORT LAUDERDALE - A man from South Carolina is suing a driver and their employer and alleges three counts of negligence against them.

The Plaintiff, John H. Swinton, filed a complaint on September 2, 2016 in the 17th Judicial Circuit Court Teddy Louis Bennett and Brothers Concrete Pumping Service, Inc. alleging Teddy negligently operated a vehicle belonging to Brothers with permission and consent, causing it to collide with John's vehicle.

According to the complaint, on January 15, 2015, the Defendant, Brothers owned, controlled, and maintained a 2006 Mitsubishi truck and gave permission and consent to Teddy to operate the vehicle. Teddy negligently operated and/or maintained said vehicle so that it collided with the vehicle John was operating. Due to his negligence, John suffered bodily injury including, but not limited to; pain and suffering, scarring, and the expense of hospitalization. he will continue to suffer these losses in the future.

On the first count, Teddy is found negligent for failing to operate the vehicle in a safe and reasonable manner. On the second and third counts, Brothers is found vicariously liable for the negligence of its agent and permissive operator, Teddy.

The Plaintiff demands judgment for damages against the Defendants, Teddy Louis Bennett and Brothers Concrete Pumping Service Inc. in the excess amount of $15,000.00 dollars and requests a trial by jury of all issues. He is represented by Arthur Garcia Jr., Esq. of Schiller, Kessler, & Gomez, PLC in Ft. Lauderdale.
