PEMBROKE PINES - A couple from Broward County sues three different people on four counts of negligence after a three-car collision.

The Plaintiffs, Michael Ben-David and Katherine Ben-David, filed a complaint on September 2, 2016 in the 17th Judicial Circuit Court against Helen Cheong Xiao, Susanne Cheong Xiao, and Linda Ann Martin alleging Susanne and Linda operated motor vehicles in a negligent manner so that it caused a three-car collision and collided with Michael Ben-David's vehicle.

According to the complaint, on March 4, 2016, Susanne was the operator of a 2009 Honda Fit with the knowledge and consent of Helen. While negligently and carelessly operating and maintaining the vehicle, Susanne caused it to collide and strike a 2013 Honda Accord belonging to Linda, thus causing her to collide a second time with a 2016 Chevy Camaro owned by Michael, causing him to suffer serious and permanent injuries. Those injuries include, but aren't limited to; physical impairment, mental anguish, and disfigurement and scarring.

On the first count, Helen is found vicariously liable as the owner of the 2009 Honda Fit and for the negligence of her permissive driver Susanne. On the second and third counts, Susanne and Linda are found negligent by failing to operate, maintain, and/or control the vehicles in a reasonable safe manner, causing Michael serious and permanent injuries.

On the fourth count, Katherine claims consortium for the negligence of Susanne, Helen, and Linda who caused her to suffer impairment of services, companionship, and consortium of the spouse. She will suffer these losses in the future.

The Plaintiffs request a trial by jury of all issues and demand judgment against the Defendants, Susanne Cheong Xiao, Helen Cheong Xiao, and Linda Ann Martin, for damages in the excess amount of $15,000.00, interests, costs, and any other relief that the court may deem just.
